By accessing and using WorkNest ("Platform," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

WorkNest is a gamified freelancing platform that connects freelancers with clients for project-based work. We provide tools for project management, team collaboration, and skill development through our XP (experience points) system.

3. User Accounts and Registration

• You must be at least 18 years old to create an account
• You agree to provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Roles and Responsibilities

Freelancers

• Must accurately represent skills and experience
• Must deliver work as agreed upon with clients
• Must maintain professional communication
• Must comply with project deadlines and requirements

Clients

• Must provide clear project requirements
• Must make timely payments as agreed
• Must provide necessary resources and information
• Must respect freelancer time and intellectual property

Area Leads

• Must fairly evaluate freelancer performance
• Must maintain impartial project oversight
• Must ensure quality standards are met

5. Payments and Fees

• WorkNest charges a platform fee on all transactions (typically 10-15%)
• Payments are held in escrow until project milestones are completed
• Disputes must be raised within 7 days of project completion
• Refunds are subject to our dispute resolution process
• All fees are clearly displayed before project initiation

6. XP System and Gamification

• XP points are awarded based on project completion and client feedback
• Levels unlock additional platform features and benefits
• XP can be lost due to poor performance or policy violations
• We reserve the right to adjust XP calculations to maintain platform integrity
• XP and levels are non-transferable between accounts

7. Intellectual Property

• Freelancers retain ownership of pre-existing work and general methodologies
• Clients own the specific deliverables created for their project
• All work must be original or properly licensed
• Users must respect copyright and trademark laws
• WorkNest retains ownership of the platform and its features

8. Prohibited Activities

Users are prohibited from:

• Creating multiple accounts
• Falsifying skills, experience, or qualifications
• Engaging in fraudulent activities or misrepresentation
• Harassing or discriminating against other users
• Sharing confidential client information
• Using the platform for illegal activities
• Circumventing platform fees or payment systems
• Posting inappropriate or offensive content

9. Privacy and Data Protection

We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and protect your personal information.

10. Termination and Suspension

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent or illegal activities
• Failure to complete projects or make payments
• Receiving excessive negative feedback
• At our discretion for platform safety and integrity

11. Limitation of Liability

WorkNest is not liable for:

• Project outcomes or quality of work
• Disputes between users
• Loss of data or business interruption
• Indirect or consequential damages
• Any damages exceeding the total fees paid to WorkNest in the 12 months preceding the claim

12. Modifications to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or platform notifications. Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of New Delhi, India.
